1. About Us
Fable by Figoodle (“we”, “us”) is an AI portrait service operated by s-basics.de, registered in Germany. We create personalised artwork from your uploaded photos using artificial intelligence and offer digital downloads, framed prints, and gallery canvases.
2. Custom-Made Products & Right of Withdrawal
All products sold through Fable are custom-made and personalised to your specifications. Each portrait is individually generated from your uploaded photo and, for physical products, printed and framed to your chosen size and specifications.
In accordance with EU Consumer Rights Directive 2011/83/EU, Article 16(c), the right of withdrawal (14-day cooling-off period) does not apply to contracts for the supply of goods that are made to the consumer's specifications or are clearly personalised.
By placing an order, you acknowledge that you are purchasing a custom-made product and that you waive your right of withdrawal. This is clearly communicated before checkout.
3. Quality Guarantee
We stand behind the quality of every product. If your order arrives damaged or defective, please contact us within 14 days of delivery and we will send a free replacement at no additional cost.
To request a replacement, email us at support@figoodle.com or use our contact form with your order number and a photo of the damage.
4. Intellectual Property
Your photos: You retain all rights to the photos you upload. By uploading a photo, you grant us a limited, non-exclusive licence to process the image solely for the purpose of generating your portrait and fulfilling your order. We do not use your photos for any other purpose.
Generated artwork: You receive a licence to use the generated portrait for personal, non-commercial purposes. This includes displaying it in your home, sharing it on social media, and using it as a profile picture.
Our brand: The Fable and Figoodle names, logos, and website content are our intellectual property and may not be reproduced without our written consent.
5. Pricing & Payment
- All prices are displayed in Euros (€) and are inclusive of VAT.
- Shipping costs are calculated at checkout based on your destination and chosen shipping method.
- Payments are processed securely by Stripe. We never see or store your full payment card details.
- Payment is taken at the time of order. Your portrait will be generated and, for physical products, printed and shipped after successful payment.
6. Delivery
Digital downloads: Delivered to your email within minutes of payment.
Physical products (framed prints & canvases): Printed and shipped by our fulfilment partner, Prodigi. Estimated delivery times are shown at checkout and vary by destination. Typical delivery is 7–14 business days. You will receive a tracking number by email once your order has been dispatched.
We are not responsible for delays caused by customs processing or the shipping carrier.
7. Limitation of Liability
- Our total liability for any claim arising from your order is limited to the amount you paid for that order.
- We are not liable for colour variations between your screen display and the final printed product, as colours may vary between devices and print media.
- The AI-generated portrait is an artistic interpretation. We do not guarantee exact likeness or specific artistic outcomes.
8. Prohibited Content
You may not upload photos that contain illegal content, violate the rights of third parties, or depict explicit, violent, or otherwise objectionable material. We reserve the right to refuse or cancel orders containing such content without notice.
9. Data Protection
Your personal data is processed in accordance with our Privacy Policy. Uploaded photos and generated portraits are deleted after successful order delivery.
10. Governing Law & Disputes
These terms are governed by the laws of Germany. Any disputes arising from these terms or your use of our services will be submitted to the competent courts in Germany.
If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform.
11. Changes to These Terms
We may update these terms from time to time. Any changes will be posted on this page with an updated “Last updated” date. Continued use of our services after changes constitutes acceptance of the revised terms.
